LIABILITY RELEASE AND WAIVER AGREEMENT

24/7 Dry Floatation Therapy

This Liability Release, Waiver, and Agreement (“Agreement”) is a legally binding document between you (“Client”) and 24/7 Dry Floatation Therapy (“WellNest”). By making a payment and/or participating in services, you confirm that you have read, understood, and agreed to the terms below.

1. Acknowledgment of Services

24/7 Dry Floatation Therapy offers state-of-the-art floatation therapy services designed for relaxation, stress reduction, and wellness. Participation is voluntary and at the Client’s discretion.

2. Age Restriction

Clients under the age of 16 are strictly prohibited from using floatation therapy services. By making a payment, you confirm that you are at least 16 years old.

3. COVID-19 Acknowledgment, Waiver, and Release

The Client acknowledges and agrees to the following:

  1. Acknowledgment of Risks:
    • The Client understands that despite sanitation and precautionary measures taken by 24/7 Dry Floatation Therapy, there remains an inherent risk of exposure to COVID-19 or other contagious illnesses in any public setting.
  2. Health Declaration:
    • The Client confirms they are not experiencing symptoms of COVID-19 (e.g., fever, cough, shortness of breath) and have not tested positive for COVID-19 within the past 14 days.
    • The Client agrees not to participate if they suspect they have been exposed to COVID-19 or are under quarantine.
  3. Release of Liability:
    • The Client voluntarily assumes all risks associated with exposure to COVID-19 and releases 24/7 Dry Floatation Therapy, its employees, and affiliates from any liability related to illness or transmission of COVID-19.

4. Assumption of Risk

The Client understands and agrees that:

  • Floatation therapy involves lying on a dry flotation pod that simulates weightlessness.
  • While the therapy is designed for relaxation, it may not be suitable for individuals with certain medical conditions, including but not limited to severe claustrophobia, heart conditions, or skin sensitivities.
  • The Company will not be held responsible for injuries, adverse reactions, or discomfort that may arise during or after the session.

5. Release of Liability

The Client agrees to waive, release, and hold harmless 24/7 Dry Floatation Therapy, its employees, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action related to:

  • Injuries, damages, or losses resulting from participation in floatation therapy.
  • Exposure to COVID-19 or other communicable illnesses.
  • Negligence by the Client or a third party.

6. Indemnification

The Client agrees to indemnify and hold harmless WellNest from any claims, damages, or liabilities brought by third parties as a result of the Client’s participation.

7. No Guarantee of Results

WellNest does not guarantee specific outcomes from floatation therapy. Results may vary based on individual circumstances.

8. Agreement to Terms

By proceeding with payment and/or participating in floatation therapy, the Client confirms:

  • They have read and understood this Agreement.
  • They meet the minimum age requirement of 16 years.
  • They voluntarily agree to all terms and conditions.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California.
